County Cannabis Ordinance Amendments

On May 11, 2022, the Santa Barbara County Planning Commission conducted a public hearing and recommended that the County Board of Supervisors adopt an ordinance amending their cannabis regulations. The staff report for the May 11th Planning Commission hearing can be found here.

On May 24, 2022, the County Board of Supervisors considered the Planning Commission’s recommendation and directed staff to make additional changes to the proposed Amendment to existing County Cannabis Ordinance and return to the Board on August 16, 2022. Those changes include the following:

  1. Change the permit requirement for new cannabis operations on AG-II zoned properties from a Land Use Permit to a Conditional Use Permit.
  2. Do not require a Conditional Use Permit for indoor commercial cannabis cultivation and indoor nurseries in Industrial zones, but allow them via a Land Use Permit.
  3. For those projects approved with a Land Use Permit, but currently being appealed, allow for an extension of the effective date of the Ordinance to be 120 days from the May 24th hearing (or September 21, 2022). After the amended ordinance becomes effective for these projects, all existing appealed Land Use Permits must be converted to Conditional Use Permits.
